If a travel agent deliberately lists a property that they know is not licesened as a hotel, nor up to fire-safety standards, is that legal?

I finally received a response from Expedia as to why they knowingly re-listed an unsafe and illegal available for booking:

“Expedia has taken substantial efforts to ensure that the property is appropriately represented to our customers. We have worked closely with the management at this property to ensure necessary changes have been made to the accommodations themselves. Indeed, representatives from Expedia, Inc. personally inspected the property. We feel that the property's management has worked with us appropriately to address all issues that have come forth. It was only after we were thoroughly satisfied with the property's product and services, that we returned the property to our listing of Expedia Special Rate hotels with the current information and star rating.”

Despite the fact they do not address the fact they are booking vacationers into illegal and unsafe properties, the next day, I received this email from a traveler, who uses the words “scam”, “mice” and “human feces” as descriptors of his Expedia WooGo Lincoln Center Experience. woogone.com/mslc.html

Maybe the Expedia representatives were at the wrong property?

No, they were not shown the wrong property but WooGo gave Expedia the Dog and Pony Show.

Did you suggest to Expedia that they send an employee there undercover as a guest?

You can assure them their experience will be quite different.

Yes, I sent them a copy of the email, along with a link to the NYC newcast w/ the undercover reporter. You would think they would be concerned about their reputation or maybe even their guests. Apparently not.
