It is open. Visited there on a Sat night last August, and the wait was AWFUL. I can only imagine it's worse, since it doesn't have WTC competing with it for visitors anymore.
CITYPASS claims that you won't have to wait in line for tickets. If that is true, that might be the way to visit ESB, as the wait AFTER getting tix wasn't too bad. http://www.esbnyc.com is official website. CITYPASS allows you to visit a number of attractions at a savings. New ESB hours are 9:30 til midnite, last elevator up at 11:15pm

The ESB observation deck is open (it was only closed for a short time after the WTC attack). Now that tourist season is arriving it will be crowded just about anytime. I find that if you go about 9:30 or 10pm (it closes at midnight) you have much less of a wait. Have fun.

I was there this past Monday and there was NO wait. There were very few people (maybe 30 total) so we had incredible views without having to look over other's heads.
I passed by on weekend nights, though, and the front door seemed to have a lot of activity. Maybe it would be best to plan it for a weeknight, rather than a weekend. Also, I went after 10 p.m. which might make a difference.
