LoveItaly - you're right - you'd think there would be something done because the meds do warn you. But what the Sheriff said yesterday was that because we can't prove that she was "under the influence" of the drug when she had the accident they can't prosecute her. The presence of the drug in her system isn't enough to prove "under the influence." The worst of it is that she is NOT the least bit remorseful and now is probably even worse since she knows there's nothing that will be done to her. I just feel horrible for the families - the 3 teens that were killed were 2 sisters and a boy who was a close to them as a brother and the 3 of them were inseparable, so that family lost a lot.

I'm probably going to get flamed for this but my complaint is pedestians who don't bother to look!
I had a drunk stripper walk out in front of my car, I nipped her with my side view mirror, she tripped and fell, and sued my insurance company and won $10,000.
The insurance company said it would cost them more in attorneys fees to fight than to settle.
She was not in a cross walk, the bartender that served her was prepared to testify in court how many drinks he had served her (he had already cut her off) and I had six witnesses with sworn statements on my behalf.
People don't pay attention. I see it happen quite frequently.
When you live in a tourist area, you have people driving from some of the largest cities in the US to people that come from one stoplight towns and everything in between.

My favorite - and maye this is an NYC thing - is all the moms who rush out into traffic (crossing against the light but sure they have enough time) pushing their kids in a stroller in front of them.
Part of the problem is in NYC a lot of people don;t drive - and have no clue how long it takes a car to stop - even if going slowly.
I barely missed one woman who rushed out from between two parked cars pushing her baby - who told me it was my fault - because "any car should be able to stop in a couple of feet." Thank god I had been stuck behind a bus and was going only about 10.

I agree BashfulLV, I can't believe that woman wasn't charged. And you can't tell me that woman had no idea she was drugged out when she got into her car. When you pick up an RX the description tells you to be careful when driving or operating machinery. At the very least that woman should be paying for each family's funeral expenses. No justice in that case.

I cannot even imagine the pain I would go through if any of my loved ones were killed or severly injured by someone with the incidents we are talking about.
It is so heartbreaking that it goes beyonds words.
Several years ago I had a serious sholder problem. I had to take a prescription pain medication. I did not drive the entire time. One thing I knew was that after about an hour of taking the meds I felt just "wonderful". But thank goodness I also knew because of my insurance career that my feeling "wonderful" also meant that I would be as dangerous on the road as a drunk.
My heart breaks for all the lost lives and the brokenhearted families who have lived through these traumas.
I hope this thread at least will remind all of us to be careful driving and also to be careful when we are pedestrians.
