Wooohooo! (or maybe not, depends on the replies), I just found this passage in my Frommer's Italy 2004 Book...Travel in the Age of Bankruptcy
pg. 58, top of the page.
Basically it says:
1) "Buy your tickets with a CREDIT CARD, as the Fair Credit Billing Act guarantees that you can get your money back from the credit card company if a travel supplier goes under (and if you request the credit within 60 days of the bankruptcy)."
2) Also "be aware that if a U.S. airline goes bust midtrip, a 2001 federal law requires other carriers to take you to your destination (albeit on a space-available basis) for a fee of no more than $25, provided you rebook within 60 days of the cancellation."
So, tell me this- My mother's Delta portions are covered under these provisions, right? (It so happens that I purchased travel insurance that covers Delta, so #1 is covered anyway.)
In regards to #2 however, her NON-codeshare Alitalia flights would not be covered, nor my father's strictly ALitalia flights, under any of the above because Alitalia is not a US carrier, correct? (The darn trip insurance does not cover Alitalia under financial default ) Or is part of this correct and does cover Alitalia as for #1. So we would get our money back, but possibly not on another flight if midtrip?

Hi PLMN - I think your relief comes from the credit card only with regard to Alitalia as I read what you've written. I'm also booked with Alitalia for October and my travel agent isn't worried. Who do you have travel insurance with? Mine, Travel Guard, according to the TA, won't pay for travel delays associated with strikes but at the time of booking did not have Alitalia on their "do not insure" list for bankruptcy. I'll have to read the policy more closely. The problem I see for all of us is how to get a flight to Italy at the last minute. Getting back is not something I plan to worry about - I'll just be real sad if I have to stay in Italy longer but I guess I'll endure. I'd be interested in seeing if anyone has experienced any bankruptcy situations and what they did. Meanwhile, I'll continue to prepare for Ivan (it's always something, isn't it?) Good luck.

Looks like Ivan will probably miss us here in Central Florida, except for lots and lots of rain. Good luck to you.

My travel insurance (in the UK) will not cover my if Alitalia goes under (who cares if they go bankrupt--they can still operate), and of course I'm flying with them in October. Check your policy carefully.
