Buddy passes can be used by non-airline people and are down the pecking order on standby from the FA. However, the FA should have stayed in the jump seat, no doubt about it. There will be some investigation by the airlines on this one.
The jump seat is not comfortable--true==but she was the one qualified to sit in it not the buddy pass guy.
As far as a suit is concerned, if you can get someone to take the case, they sue for anything. Southwest was sued for telling a passenger she wasn't dressed appropriately.

FainaAgain and NeoPatrick (right on the money NP), laws vary from state to state, but generally, and I believe this is true of NY, you have to have an underlying physical injury to successfully sue for emotional distress. The only other alternative is "intentional infliction of emotional distress," where the wrongful conduct qualifies as "outrageous" AND the victim suffers "severe" emotional harm (that is, the kind you have to seek medical attention for).
Anyone can sue for any reason by simply filing a complaint and paying the filing fee to the clerk of court, as Gretchen said. My point is that bogus claims will eventually get weeded out, but that will involve the efforts of paid court personnel, including the judge who eventually grants JetBlue's motion for summary judgment. So the taxpayer ends up getting soaked--IMHO a misuse of our courts.

For years my uncle worked as one of the chief engineers on the delivery line at a big airline manufacturer with initials D, then McDD, and heard lots of stories from airline people taking delivery of their shiny news...
He loved to tell a story about a lady with an ample tuchis who had the misfortune to have the holding tank decompress while she was seated in the aft lav on a DC-8. She formed a rather excellent vacuum seal on the seat, and was stuck - literally - in that embarrassing position until the crew could figure out how to get her unsealed. I don't know if any injury resulted, poor dear.

I'm sure the guy looked like a "terror threat" and the pilot told him to go sit in the bathroom and they probably locked his ass in there.
The non-rev flight attendant can't just take his seat if she agreed to sit in the jumpseat. And buddy pass riders can't sit in the jumpseat either.
And just as usual-the cheap ass flight attendant uses a jump seat to sit in first class for free!

Well, this thread brings to mind the famous "tipping the flight crew" thread. When he wins his suit I assume he will seek out the crew to give them their well-deserved tip. That's if his "tuchis" is not stuck in/on/at his "seat".

AND - if it's true, the pilot needs to be fired for stupidity... I saw the guy on the Today Show today, and it really will be interesting to see what's going to happen. I guess the FAA is now very interested in finding out if it's true since having someone in a bathroom is SO against FAA rules....
