It would never hold up in a court of law of law today.

Guy Fawkes was probably innocent. The "plot" may well have been a Stuart invention, designed to suppress English anger at the takeover of the English monarchy by a Scot who was into gay rights, against smoking and himself suspected of being a Papist.
