Who should pay?

Need advice....Amanda was tired of carrying her videocam and asked Yolanda to hold it for a while as they wandered around Paris. After a short while, Amanda and Yolanda hailed a cab and Yolanda put the video camera on the seat between them. When they left the cab, neither one remembered the camera, and the cab drove off with it. <BR>Now the question is,in your opinion, who should buy the new camera?

It was an accident, but Yolanda should be gracious and for the sake of the friendship, shuld offer some monies towards a replacement.

I agree with Judge Judy, but suggest that Amanda file a claim with her homeowner's or renter's insurance carrier. (Moral: you can either travel and enjoy yourself or you can shoot videotape...).

What does "a little while" mean? I think it was Amanda's responsibility to see that it was taken out of the cab with them.

If Yolanda had asked to borrow Amanda's videocam and then left it someplace, I'd say it would be Yolanda's responsbility to replace it, since Yolanda benefitted from the arrangement. <BR> <BR>However Amanda asked Yolanda to do a favor for her by carrying it. Thus Amanda benefitted from the arrangement and should bear responsibility for the subsequent loss.

Hopefully, Amanda has insurance and it will pay. If Yolanda wants to maintain the friendship she might offer to split the deductable.

Yolanda has zero reason to feel guilty or responsible. It is Amanda's videocam and Amanda's responsibility. If Amanda is making an "issue" of it or laying a guilt trip on Yolonda, Yolanda would be better off traveling with another "friend."

Although I believe posters are correct to state that it is Amanda's responsibility to replace the camera, I know that if I were Yolanda I would feel responsible. I would offer to help pay for the camera. To ease my conscience and also to acknowledge my responsiblity in accepting the camera to hold for Amanda. <BR> <BR>I always try to teach my boys not to accept responsibility for a request if they are unable to follow through with the task completely. <BR> <BR>Does anyone else agree? <BR> <BR>linda

Amanda, because if she was too lazy to carry the thing, she should at least make sure it makes its way out of the cab and/or pay for its replacement.

For my two centimes, I would say the camera is history, forget it!!! <BR>They both had responsibility and neither remembered it, it is just part of the fun of traveling. <BR> <BR>Ciao, <BR> <BR>Randy Smith

Yolanda should sue Amanda for mental anguish for even suggesting for a second that she had any part in this careless act. In fact, by asking Yolanda to carry it, it sounds pre-meditated. Double the punitive damages. <BR>

Yolanda should be struck with a wet noodle for having a lame friend like Amanda. When traveling with friends, if you can't tote your own crap, don't bring it.

So Amanda said, "Here, Yolanda, hold my video camera for a while". Yolanda did not offer to hold the camera, and she's not responsible for it. Amanda should have made sure one or the other of them had the camera when leaving the cab.

the real isssue is ducked responsibility. it is amanda's camera and ultimately her responsibility to care for it. good lesson in life could have been much worse
