Uber and Lyft should be very forthcoming about what to expect insurance-wise if you take a ride in a car operated by one of their drivers and get into an accident. Admittedly with standard auto insurance, one expects delay, obfuscation, willful denial of legitimate claims, etc., but I'd still like a clear breakdown of whose insurance is responsible for the passenger.

Regular auto insurance policies will not cover accidents that occur if the car is used for commercial purposes. One has to state that when buying insurance and the rates will be signifcantly higher than for purely personal use.
That is one of the things that T&LC usually regulate. |

Umm. I don't have a dog in this race, but hasn't it also been stated "many times" that Uber drivers' insurance policies may NOT be effective or may not be in effect at any given time? Saying that something has been stated many times really doesn't mean much. It's been stated many times that George W Bush was a great President. I rest my case. |

I am going on my own experience with taxis and with Uber.
Uber has been FAR & AWAY the better experience, on every count: swift pick-up, professional and courteous drivers, cold water bottles in some cars, very nice vehicles, good prices, ease of use, instant e-mail response the one time I had a question. Drivers use GPS, so you must have a good street address for them to plug in. Taxis, on the other hand, are the opposite story. Stinky cabs, surly drivers, tip expected, . . .. We have never had any issue with a personal injury in a cab or in Uber. We are lucky to have great health insurance, and I believe the insurance companies would duke it out if there were bills to pay. Our son was in a crash in a cab in L.A, on its way to LAX, on Lincoln Blvd. It was very minor, thank god. But it caused him to miss his flight, and have to pay for a hotel room that night that had a free airport shuttle. After several e-mails to the cab company, we were finally reimbursed for the hotel room and one meal. Another cab side-swiped my son's car, at the Pepsi Center roundabout in Denver. Really did a job on the driver's side door and of our Honda. Again, thank god, DS wasn't hurt. Allstate took care of it, and I assume they made the cab company pay them back. So, our cab experiences have not been good. We will use Uber whenever possible. |

If Uber operates legally within a jurisdiction that doesn't require fingerprints as part of a background check then they are not disregarding safety regulations. If a jurisdiction requires fingerprints then Uber should comply or negotiate an agreeable alternative. As currently would be the case in San Francisco. An Über driver is accused of raping a woman in New Delhi and the fear mongering is rampant. A NYC taxi driver gets convicted of raping a woman in Brooklyn and no one is calling to take the cab industry apart b/c of it. http://www.nydailynews.com/new-york/...icle-1.1777650 I don't know for certain but I'd speculate that taxi drivers are more often the victims of crime than the perpetrators of it. |
I do have an unrelated (to this discussion of liability coverage) about Uber? The other day I clicked on the link, and it said something like "due to high demand at this time, the price could be up to 2x the normal rate. Do you accept this?" What does that mean - at what point in the process do I find out the actual cost, or estimate based on where I am and where I'm going?

I certainly feel much empathy towards IMDonehere on this thread. They are giving VERY GOOD ADVICE to all of you on this subject and some of you are being dismissive without looking into these points thoroughly.
For example, on the UBER issue, you don't simply read a FAQ page on the Uber website and stop there. Did anyone click on that hyperlink to the blog and then continue on to actually look at the Certificates of Insurance? Make sure you pick the correct one for your specific needs, because there are several. I note that coverage lapses in a few days. What do you do then? Might be a good idea to check the financial stability (A.M. Best Co.) of whatever company that is offering the coverage for UBER. Remember, resolution of some of these accidents can go on for years or decades. Also please keep in mind that you are speaking of liability policies. Only a handful of states have adopted (modified) no-fault laws. Those policies may not even become involved if their driver wasn't at fault or only partially, if there is contributory/comparative negligence. Remember you are the one out on the limb if the omnibus policy lapses without renewal/replacement - and the driver doesn't have proper coverage in force - or if any of these carriers become insolvent. With respect to the other issue (AirBnB, etc.), even if the individual carries a personal homeowners policy, it doesn't mean that there will be coverage. The policy might specifically exclude this operation. And for those who think that their homeowners policy will cover this type of situation under ALL circumstances, I'd be making a very quick call to my insurance agent and explaining THOROUGHLY my *exact* operations. You may need to purchase a different type of coverage. |

You have to know the nastiest ones here, would complain the loudest and act like the unknowing agrieved party if something happened to them using UBER or AirBnB.
