j_999_9: I'm sorry for any confusion I caused. In the vehicle code, there are two separate requirements regarding registration. First, your registration must be current-that is all the required inspections, fees, and paperwork are completed and the state DMV has issued a renewal. Second, you must carry proof of that registration and present it if you are stopped. You can have a vehicle that is completely and correctly registered and still be cited if you do not present that documentary proof when requested. The same sort of requirements exist for driver's licenses and for proof of insurance.
Stjohnbound was correct. I am not aware of any state anymore where a police officer has any influence at all on the amount of bond required for any given violation. Some of the more rural states may have followed that practice decades ago. Bond (in some cases called bail) amount is set either by the judges of the county courts in some states or by state law in others. I have worked under both systems and in every case, when I wrote a citation, I had to write the court in which the case was to be filed, the appearance date, and the bond amount required. I had no influence at all on any of these items, they were all pre-established by the courts or by state law. My only discretion was whether or not to write the citation in the first place. |
Interresting dwooddon. I believe you are a police officer? :)But can a police officer change the actual type of infraction to cause a higher penalty? I ask that because I have never heard of a $300 ticket for just going 10 miles over the speed limit, but who knows. Does that sound right?

Hi travelingwifey, my grandson recently went 10 miles over the speed limit on I-80 here in N CA. It was night. He saw the red light from the CHP. He was in the left (fast lane). He got scared and didn't think he should go across all the lines to stop off the right hand lane of the freeway so he pulled over to the off shoulder off the left hand lane. The State of CA find him something like $870.00 as the CHP wrote him up for speeding (shame on my grandson) and also for something called an emergency vehicle violation..for pulling off of the left lane). He went to court, went before the judge. He pleaded no contest. The judge talked to him. The judge had the authority to change the fine set by the State of CA. He was consequently finded $180.00 for speeding. The judge waived the fine for the other violation after talking to my grandson. I went to court with my grandson so I am familar with the cirumstances.
I do not blame the CHP. I blame my grandson for speeding. I felt the judge was more than generous with his decision. We have so many deaths and serious accidents on I-80 due to speeders and incompetant drivers it is pathetic. And having been in the insurance business for a long time I still cringe regarding horrendous accidents and mayham caused by drivers that do not follow the DMV rules. We just had a 28 year old Rio Vista policeman hit by a speeding teen who also crossed the double line a week ago. This policeman died on his birthday. He had been married 3 weeks. We just had 2 sibilings killed and 10 other children injured in our city a day later due to a young man who was speeding on one of our city streets. There was an article in the paper this morning that our local hospital is requesting donations to help the parents of the various injured children as they cannot work because they have to take care of their injured children. They consequently, due to no paycheck, cannot pay their rent, utilities, buy food etc. Please everyone, follow the rules of the road. A vehicle can be a lethal weapon. A $300.00 fine is nothing compared to what could have happened. Thank you. |
Ouch. That's what I was thinking. Perhaps it was a different type of citation other than your basic speeding ticket. I do think that there is some type of law that if you are the lead speeder (with others following you) the fine may be higher but I'm not sure about that at all.
