No one is questioning whether a law exists prohibiting smoking in certain establishments! There is a law, we know, but the point is that many establishments continue to allow smoking, even where it is prohibited according to law. So, for the woman who asked the question, yes, smoking is prohibited in most restaurants. Do people still smoke? YES! <BR> <BR>Geez!

Some of the notes in the thread contained misinformation. The purpose of my note was to provide exactly what the law states with regard to smoking in restaurants. I am well aware the law is often ignored but people should be aware there is a penalty for smoking where it is not allowed. The penalties are <BR> <BR>The fine for individual smokers who violate the law has been doubled from $50 to $100. In addition, fines for building managers, restaurant owners and others <BR>who control the use of public places have been doubled from $100, $200 and $500 for the 1st, 2nd, and 3rd violations to $200, $400 and $1,000. <BR> <BR>I don't know that anyone has been fined for smoking in a restaurant or other public place but the visitor from the UK and everyone else who reads this thread should be aware of the penalty if imposed.

Oh for heaven's sake, lighten up...or light up! If New Yorkers start following every law on the books what a boring place it will be.
