Rentals under 30 days illegal in Napa County?

VRBO is advertising a guest house rental with the following owner's admission:

P.S. -- A word on our crazy government bureaucracy:

Napa County has strict limitations on vacation rentals - anything less than 30-days is illegal (go to jail illegal). So every country property on VRBO in Napa County offering daily or weekly rates is asking you to break the law and suffer the consequences. So no matter how short of a stay you want, we have to sign a 30-day rental agreement with you. You can stay just a week or two but you'll have to pay the same $3,000 a month and sign a 30-day rental agreement. We will only sign 12 rental agreements a year.

That's bizarre. There's a few rentals in Napa for just a night to a week.

You can find listings for Napa on AirBNB for less than 30 days including entire homes not just a room in a home.

I don't know the napa county laws re. air bnb but this is an advertisement for an entire house to be let illegally. I'm a little surprised vrbo allows this type of listing. buyer beware, as always.

My guess is that they would be considered a professional accomodation entity, and subject to local hotel requilations.

When I've rented long term for business stays in one local city, I found out that an accomdation tax (hotel tax) is not payable if you rent a place, even if it's a hotel room, for 30 days or more.

What the owners want to do, in this case, is pocket the rental money an pay no taxes on it. Yes, it's illegal, but it's illegal for them not to declare and pay the hotel tax for shorter term stays.

Technically, what they say is correct, but they are only correct in that they don't want to be subject to being called a "hotel" and have to pay appropriate taxes.

Short term vacation rentals are illegal in Napa County. They are permitted in the city of Napa and in St. Helena now as well. However, outside the respective towns, county ordinances prohibit a large variety of commercial enterprises. It's their way of trying to maintain the ag preserve.

This would be a strong deterrent!
