Investigators assume they made a new card (apparently they do they do this all the time with debit and visa cards) and had seen us use our card or had been a merchant when we used it and they saw our pin. Who knows. Just know it was a terrible experience. We are still fighting this whole thing but it looks like a hopeless situation and B of A has been no help. Needless to say we don't bank there anymore. We have heard of some others (from our local PD) who have had the same problem with debit cards and are having trouble collecting. So don't feel we are the only ones.
