Employment discrimination law isn't my field, but I'll try to give you the best answer I can, Stephanie. There are a couple of issues. One problem is if the casino hires only females to serve drinks in casinos. You can consider gender in filling a job only if gender is a BFOQ (Bona Fide Occupational Qualification). In other words, if you can show gender is important to performance of the job, then you can pick the gender you want. <BR> <BR>The other kind of discrimination would be treating male and female employees differently. If you're going to have a weight requirement for one gender, you must have it for the other. <BR> <BR>So how about modeling agencies? I assume if the garment is a bikini, getting a woman is a BFOQ. Getting a skinny one is probably permissible on several grounds, because a fat one can't fit the product, and being fit is probably imposed on all models, male and female. <BR> <BR>So why can't you require cocktail waitresses to be skinny and stacked? Because you don't have to be skinny and stacked to serve drinks, and similar requirements aren't imposed on men. <BR> <BR>Hope that helps.
