That 'headline' was posted 3.5 years ago. IME there were more empty seats back in 2011/2012

Or if you have nerve: I have seen this twice so far this year. Middle seat passenger get up after flight levels off and simply walks to EC+ seat and sits down. Once lady was sitting next to me another times one kitty corner across the aisle. Staff didn't blink a eye..........

Several times before take off, FAs make an announcement that the E+ seats are for purchase, you can't just take an empty seat. I have seen flight attendants ask the person trying to move into E+ if they want to purchase that seat, and if not, they tell them to go back to their assigned seat.

I'm sure there are differences in how various FAs handle this, and I'm sure some of it depends on how full the flight is.
