Here's the actual NYC law about short term apartment rentals
I'm not a lawyer
There are so many questions on Fodors about the recently redefined NYC law disallowing apartment rentals of fewer than 30 days. Common questions are what if it's a co-op, what if it's a condo, what if it's a townhouse, what if it's a corporate apartment, why would VRBO or Homestay or Craigslist or AirBnB allow the ads if it's not legal, etc.

There are probably some legal rentals out there and of course, some people will still decide to take their chances. I hope this will give people some real useful information so they can understand why so many here keep saying "it's illegal" Ultimately everyone will decide for themselves what they want to do

There is another factor involved besides the law banning sublets for less than 30 days.
Almost all co-ops and many condos (which is a huge percentage of apts in NYC) do not allow for this type of sublets in their by-laws. So not legal - but not possible. Second, most leases for rental apartments ban subletting by the tenant without approval of the landlord (which they usually will not give).
So even if you can wend your way around the many listings that are outright scams (aprs don't exist or are nothing like advertised) it is VERY difficult to find a legal sublet. One of the only options is people who own a 2 family house, live in one part and are wiling to sublet the other. The problem is that this is really unknown in Manhattan (where people want to stay) and not even very common in the outer boroughs (from which it can easily take an hour or more to get to and from Manhattan).
Strongly suggest that anyone thinking of subletting in Manhattan check here with the address - or require that the renter provide them documents proving it is a legal rental.

OK< so the OP was in 2012 but given the on-going actions within the City Council and all, it doesn't hurt to bring up the subject every once in a while. Especially since a posting 4 years old will get buried under all the postings that came after it.

Another lecture tacked onto a likely spam post topping a 4 year thread is overkill for a topic that gets bleated about almost weekly if not more often.
YMMV. I get it, though, some people love to hear themselves yammer w/o taking even a second to see that no real question is being asked or answered.

FWIW, I agree with obxgirl. nyt has shared this information many, many times, saying the exact same thing, with unceasing vigor. I know she feels passionately about the subject because it's her fishbowl, but it gets tiresome, it really does, especially when there is nothing new to say.

Someone's Nonnie from the old country comes to fodors today with a great deal on an efficiency compared to the cost of hotels in a nice neighborhood. Nonnie flies a long flight and takes the board recommended car service to what ends up being an abandoned warehouse. Which of you will be putting Nonnie up for the night? Just because you are sick of hearing the reality and warnings and would silence them? Do neither of you know how to scroll or hit delete?
I guess it is no different then me warning people about dangerous conditions in Hawaii. Enough already with my doom and gloom? Fck no - if it saves one life - well imagine it the life of one of your most precious loved ones.
This forum is supposed to share information with others, not silence them when they are speaking truth in travel.
