compensation for loosing a bag

on February 2015 I flew from Tel Aviv to Hawaii with connection in LA with Aerofloat.
When i got to LA I've been told that my bag is still in Moscow because of a problem..
I flew to Hawaii without anything and had to spend my first day shopping for cloths. on m way back i contact the company and they said they will compensate me for my expenses. its been 10.5 months later and i still didn't get anything, i've been in a weekly contact with the manager and the Baggage Service manager in LA since then by emails and i'm always getting excuses of why they didnt do anything till now- its always excuses of them being too busy\ cant handle it right now\ dont have the way to transfer the money...

What can I do? i tried to be patient but its impossible anymore

I assume you didn't have travel insurance?

Do you have personal property insurance (renters or homeowners)? Does the loss exceed your deductible? If so, I'd file a claim with your insurance company and give up on the airline.

Your insurance company won't compensate you for your expenses, but there just might be some coverage for the items you lost. They'll probably want documentation of the lost items and documentation that the airline has failed to pay (all those e-mails, etc).

It's worth a shot.

Good luck.

A bag that is delayed can cause a lot of inconvenience. However it is unclear from your post whether your bag was 'lost' as the airline would define it, if I have understood your situation. Your bag was 'found' at least at one point - but it was in Moscow, at the time of your inquiry at the transfer point in LA.

***When you arrived in Hawaii, what did they tell you about the status of your bag? *** Was it sent on to Honolulu (or wherever your flight arrived in Hawaii) and how long did that take?

This will make a difference as to how much you can expect to receive.

Some people have reported success in getting at least some cash up front, immediately at destination (i.e. in the airport) in order to cover the cost of a few things (nothing too expensive, just essentials.) Unfortunately that ship seems to have sailed.

If you are truly determined, read the thread below. It's long, but may provide some clues.

If I read this correctly, the OP just wants someone to pay for all the things he/she bought during the time the bag was delayed. It isn't clear how long that was or how much money is wanted out of Aeroflot. Or how long it took to get one's bag in Hawaii. Or if one never got it, the post is really unclear.

I've never heard a single good thing about that airline so I'd probably write it off if it is just temporary expenses.

I had that happen by Aer Lingus many years ago and just wrote them a letter with receipts and they paid me, it wasn't that much trouble. But I was very reasonable, I didn't ask for very much, as I had some necessities in my carryon (as everyone should). I always put in my carryon some extra underwear and a Tshirt to sleep in, also. Since I didn't get my bag for over a day, I asked them to pay for a pair of shoes, that was about it, as I had to go out to dinner that night in a place where I couldn't just wear my sneakers that I had on. My shoes were reasonably priced, not Louboutins, also, just something from a cheap shoestore in Dublin.

I wouldn't count on anything with a foreign airline, I just don't think there is realistically anything more you can do. I think it goes with the territory when you book certain airlines, you are taking a risk when you book Aeroflot, especially if you live in another country.

Where did you buy the ticket? (Hopefully not online directly from Aeroflot)

I ask because the laws of the country where you bought the tickets apply. It depends on the country whether you are protected by the Warswaw Convention or the Montreal Convention (you will read it in the fine print of your ticket). Russia has signed the Warsaw Convention.

Both conventions provide a compensation for the loss of baggage.

With this information, you know what you can demand, but you may need the help of a lawyer or of a consumers rights organization.
